Privacy Policy

This Privacy Policy describes how Tensor Wave Inc. (“Tensor Wave,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you use the Theory 808 platform at theory808.com and related services (the “Service”). By using the Service, you consent to the practices described in this policy.

1. Information We Collect

1.1 Information You Provide

  • Account Information: Name, email address, and password when you create an account. If you sign in with Google, we receive your name, email, and profile picture from Google.
  • Payment Information: Billing address and payment details. Payment card numbers are processed directly by our payment processor (Stripe) and are never stored on our servers.
  • User Inputs: Text prompts, lyrics, style descriptions, and any other content you provide to generate music.
  • Generated Outputs: Audio tracks, metadata, and associated parameters produced by the Service.
  • Communications: Messages you send to us via email or support channels.

1.2 Information Collected Automatically

  • Device and Browser Information: IP address, browser type, operating system, device identifiers, and screen resolution.
  • Usage Data: Pages visited, features used, generation parameters, timestamps, referring URLs, and interaction patterns.
  • Cookies and Similar Technologies: We use cookies, local storage, and similar technologies for authentication, preferences, analytics, and security. See Section 7 for details.

2. How We Use Your Information

We use your information for the following purposes:

  • Providing the Service: Processing your prompts, generating audio, managing your account, and delivering subscriptions.
  • Improving the Service: Analyzing usage patterns, diagnosing technical issues, and improving generation quality and user experience.
  • AI Model Training: User Inputs and generated outputs may be used to train and improve our AI models and the models of our third-party AI providers. See Section 3 for details and opt-out instructions.
  • Communication: Sending service-related notices, security alerts, subscription confirmations, and (with your consent) promotional communications.
  • Fraud Prevention and Security: Detecting, preventing, and responding to fraud, abuse, and security incidents.
  • Legal Compliance: Complying with applicable laws, regulations, legal processes, or enforceable governmental requests.

3. AI Model Training and Opt-Out

We may use your User Inputs and generated outputs to train, evaluate, and improve the AI models that power the Service. This helps us deliver better-quality music generation for all users.

Opt-Out: You may opt out of having your data used for model training by contacting us at hey@theory808.com with the subject line “Opt Out of Model Training.” Opting out will not affect the core functionality of the Service, but may limit our ability to personalize your experience.

4. How We Share Your Information

We do not sell your personal information. We share your information only as follows:

  • Service Providers: We share data with trusted third-party providers who perform services on our behalf, including payment processing (Stripe), cloud infrastructure hosting, analytics, and email delivery. These providers are contractually obligated to protect your data and may only use it to provide services to us.
  • AI Model Providers: User Inputs are transmitted to third-party AI model providers to generate audio outputs. These providers process data according to their own privacy practices and data processing agreements with us.
  • Legal Requirements: We may disclose your information to comply with applicable laws, regulations, subpoenas, court orders, or other legal processes, or to protect the rights, property, or safety of Tensor Wave Inc., our users, or the public.
  • Business Transfers: In the event of a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity.
  • With Your Consent: We may share your information for any purpose disclosed at the time of collection with your consent.
  • Public Content: If you make your generated tracks public, they will be visible to other users on the Airwaves along with your display name.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. After account deletion, we will delete or anonymize your personal data within 90 days, except where retention is required for legal compliance, fraud prevention, or dispute resolution. Generated audio files associated with deleted accounts will be removed from our servers within 30 days. Anonymized and aggregated data that cannot identify you may be retained indefinitely.

6. Data Security

We implement industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS), encryption at rest, access controls, and regular security assessments. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

7. Cookies and Tracking Technologies

We use the following types of cookies and similar technologies:

  • Essential Cookies: Required for authentication, security, and core functionality. These cannot be disabled.
  • Analytics Cookies: Help us understand how users interact with the Service, identify issues, and measure performance. We may use third-party analytics services.
