Acceptable Use Policy

Effective Date: March 30, 2026

This Acceptable Use Policy (“AUP”) applies to all users of the Theory 808 platform, operated by Tensor Wave Inc., and is incorporated by reference into our Terms of Service. Violation of this policy may result in content removal, account suspension, or permanent termination without refund.

1. Prohibited Content

You may not use the Service to generate, upload, share, or distribute content that:

1.1 Illegal Content

  • Violates any applicable local, state, national, or international law or regulation.
  • Promotes or facilitates illegal activities, including but not limited to drug trafficking, weapons sales, or financial fraud.

1.2 Harmful or Violent Content

  • Promotes, glorifies, or incites violence, terrorism, or physical harm against any individual or group.
  • Contains credible threats of violence or harassment.
  • Promotes self-harm or suicide.
  • Constitutes or facilitates child sexual abuse material (CSAM) in any form. We maintain a zero-tolerance policy and will report all instances to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.

1.3 Hate Speech and Discrimination

  • Promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age.

1.4 Deceptive and Fraudulent Content

  • Impersonates any person or entity, or falsely claims an affiliation that does not exist.
  • Creates deepfake audio intended to deceive, defraud, or mislead others.
  • Generates content designed for phishing, scams, or social engineering.
  • Falsely represents AI-generated music as having been performed, sung, or produced by a specific real person without their explicit consent.

1.5 Intellectual Property Infringement

  • Deliberately reproduces copyrighted musical compositions, sound recordings, or lyrics owned by third parties.
  • Infringes upon trademarks, trade secrets, or other intellectual property rights.
  • Circumvents digital rights management (DRM) or other technological protection measures.

1.6 Privacy Violations

  • Discloses personal, confidential, or sensitive information about another individual without their consent.
  • Creates non-consensual intimate or sexual audio content.

2. Prohibited Activities

You may not:

2.1 System Abuse

  • Circumvent, disable, or interfere with usage limits, rate limiting, credit systems, or other security features of the Service.
  • Use automated tools, bots, scrapers, or scripts to access the Service in a manner that exceeds reasonable use or places undue burden on our infrastructure.
  • Attempt to gain unauthorized access to any part of the Service, other users’ accounts, or our systems.
  • Interfere with or disrupt the integrity or performance of the Service.

2.2 Competitive Misuse

  • Use the Service or its outputs to develop, train, or improve a competing AI music generation model or service.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or model weights used by the Service.
  • Systematically download, cache, or store generated outputs for the purpose of creating a competing dataset or service.

2.3 Resale and Redistribution

  • Resell, sublicense, or redistribute access to the Service without our prior written authorization.
  • Share account credentials with multiple users or operate an account on behalf of third parties without authorization.

2.4 Spam and Abuse

  • Generate content in bulk for the purpose of spamming, cluttering, or manipulating external platforms.
  • Use the Service to generate content designed to manipulate search engine rankings or social media algorithms.

3. Music-Specific Guidelines

  • Artist Impersonation: Do not use prompts, lyrics, or style descriptions designed to impersonate or closely replicate the voice, style, or identity of a specific real artist without that artist’s explicit consent.
  • AI Disclosure: When sharing or distributing AI-generated music in professional or commercial contexts, we encourage (and in some jurisdictions may be legally required) disclosure that the content was generated with AI assistance.
  • Sampling and Remixing: If you incorporate AI-generated outputs into derivative works, you are responsible for ensuring compliance with applicable copyright and licensing requirements.

4. Content Moderation

We employ a combination of automated systems and human review to monitor content on the Service. We reserve the right to review, remove, or disable access to any content that we determine, in our sole discretion, violates this policy or poses a risk to our users or platform.

We are not obligated to monitor all content and do not guarantee that prohibited content will be identified or removed in a timely manner.

5. Enforcement

Violations of this policy may result in one or more of the following actions, at our sole discretion:

  • Warning: A notice to cease the prohibited activity.
  • Content Removal: Removal of offending content from the Service.
  • Temporary Suspension: Temporary suspension of your account and access to the Service.
  • Permanent Termination: Permanent termination of your account without refund.
  • Legal Action: Referral to law enforcement or pursuit of legal remedies where appropriate.

The severity of our response will depend on the nature, frequency, and severity of the violation. We are not required to follow a progressive enforcement process and may skip directly to termination for severe violations.

6. Reporting Violations

If you encounter content or behavior on the Service that you believe violates this policy, please report it to us at hey@theory808.com with the subject line “AUP Report.” Include as much detail as possible, including the content in question, the user involved, and the nature of the violation.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in our Service, legal requirements, or enforcement practices. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
